Terms of use for agencies (beta)

Scope and operator

These terms apply to the use of the software-as-a-service platform HicretYolu.app at https://www.hicretyolu.app by travel agencies (the “agency”). The platform is operated by [[Firmenname]], [[Rechtsform]], [[Anschrift (Straße, PLZ, Ort, Land)]] (the “operator”).

The platform is only available to businesses (entrepreneurs under § 14 BGB or merchants (tacir) under Turkish commercial law) that organise or arrange Umrah or Hajj travel. Consumers cannot enter into a contract for its use. Pilgrims use the pilgrim area as customers of their agency; these terms do not apply to them.

Conclusion of the contract in the closed beta

During the beta, only invited agencies can join: the agency receives an invitation code, submits an application (company name, contact person, email address, phone number, short name), the operator reviews it, and the contract is concluded when the operator approves it. The agency then receives a link valid for 72 hours to set up its account. There is no right to approval.

These terms and the data processing agreement become part of the contract upon approval.

Beta phase and services

The platform is in a closed beta. Features may be added, changed or removed, no particular availability is guaranteed, and errors and outages may occur. Feedback is welcome and may be used to improve the platform.

Features include package management, bookings with payment plans and manually recorded payments, a pilgrim area with email link login, document upload, reviews and web push, tour guide tools (attendance, Kafile group messages, Ravza appointments, hotel vouchers, Zemzem distribution), offer PDFs, the AI assistant Kaswa, surveys and Rehber content. A WhatsApp integration exists but is currently not active.

No online payment, no travel services

No payments are processed through the platform and no card data is handled. The operator is not a payment service provider, tour operator or travel intermediary and does not become a party to the travel contracts between the agency and its customers.

Obligations of the agency

The agency in particular undertakes to:

• provide accurate information and keep it up to date,
• fulfil its own obligations as a tour operator or travel agency, such as the TÜRSAB-Belge, official permits and package travel law,
• keep access data secret and assign staff accounts and roles only as needed,
• collect and enter personal data of its customers and pilgrims lawfully, obtain consent where required and inform them,
• not upload unlawful content or misuse the platform.

AI assistant Kaswa

Kaswa answers questions automatically using a language model. Answers may be incomplete or wrong. Kaswa makes no binding commitments, quotes no binding prices, concludes no contracts and makes no decisions; only the agency’s own statements are binding.

Fees

Use during the beta: [[Entgelt während der Beta]]. Commissions and platform invoices are subject to a separate agreement: [[Vereinbarung Kommission/Entgelt]].

Data protection

For the personal data of the agency’s customers, pilgrims and travellers, the operator acts as processor and the agency as controller; the data processing agreement (Art. 28 GDPR, KVKK m. 12) forms part of the contract. For its own data, the operator is controller and its privacy policy applies.

Suspension, term and termination

The operator may temporarily suspend access in case of concrete indications of misuse or security risks. The contract runs for an indefinite period and may be terminated with [[Kündigungsfrist]] notice; the end of the beta is announced [[Frist Ankündigung Ende der Beta]] in advance.

After termination, the operator deletes the agency’s data within [[Frist Datenlöschung nach Vertragsende]] unless statutory retention applies; backups expire on their own schedule (encrypted dumps after 90 days). Export beyond the console functions: [[Umfang und Format Datenexport bei Vertragsende]].

Liability

The operator is liable without limitation for intent, gross negligence and injury to life, body or health. For simple negligence, liability is limited to breaches of essential contractual obligations and to the foreseeable damage typical for the contract. Mandatory statutory liability remains unaffected.

Changes, governing law and final provisions

Changes to these terms are announced at least [[Frist Ankündigung AGB-Änderung]] in advance; the agency may object and terminate. Governing law: [[Anwendbares Recht]].
